In February 2025, the Procurement Act 2023 came into full force in the United Kingdom. And most small businesses have absolutely no idea what that means for them.


Let me tell you.


The old system, the Public Contracts Regulations 2015, was designed in an era when procurement was complicated, opaque, and frankly hostile to smaller suppliers. The new system was specifically designed to change that.


Under the Procurement Act 2023:


There is a single, transparent digital platform where all public procurement notices must be published. No more hunting across seventeen different portals.

Buyers must now consider SME access when structuring contracts. The door has been legally opened wider.

Social value is no longer optional. Buyers must assess how your business benefits the community, the environment, and the workforce, and they must score it.

Transparency obligations mean you can request feedback on why you lost. You now have the legal right to understand what went wrong.


This is the most significant shift in UK procurement law in a decade. And the businesses that understand it first will absolutely clean up.

The Three Things Killing Your Bids Right Now

1. Your compliance documentation is out of date.


CHAS expired six months ago; Your health and safety policy is from 2019; Your modern slavery statement still references legislation that has since been updated. You did not notice, but the evaluator did. Many bids are eliminated before they are even scored. Not because the business cannot deliver but because a box was not ticked. Check every single accreditation and policy document you hold. Check it today.


2. Your methodology answers the question you wanted to answer — not the one they asked.


This is the single most common mistake in bid writing. The buyer asks: “How will you ensure service continuity during TUPE transfer?” And the bidder writes three paragraphs about how experienced their team is. That is not what was asked. Read the question;Answer the question; Evidence the answer; Repeat.


3. Your social value response is generic.


“We will support local employment and reduce our carbon footprint.” That sentence appears in approximately eighty percent of social value responses submitted to UK public bodies. It scores almost nothing. Evaluators want specifics. How many apprentices? From which postcode? By what date? Measured how? The more specific you are, the higher you score. Generics lose marks. Always!


The Contract Is Already Out There


Right now, today, as you are reading this, there are live contract opportunities on Find a Tender Service and Contracts Finder that your business is eligible to bid for. Some of them are worth hundreds of thousands of pounds. Some are worth millions.


They were published this week. Some close in a matter of weeks.


However, the majority of eligible UK SMEs will not submit a bid. Not because the contract does not suit them. Not because they cannot deliver the work. But because nobody told them the opportunity existed. Or they looked at the tender document, felt overwhelmed, and quietly closed the tab.
